AN ISLE of Wight man has been banned from the road for refusing to give police a sample of breath, despite claiming he had not consumed alcohol.

Dylan Tuckey, of Hinton Road, Newport, appeared before Isle of Wight magistrates on Tuesday, May 30.

The 23-year-old admitted failing to provide a specimen for analysis, in Newport, on May 15.

Prosecutor, Ann Smout, told the court police had been alerted to a Ford transit van travelling along Fairlee Road at around 6.30pm.

The vehicle was stopped, with police believing it had no valid MOT.

Tuckey was the driver and refused to provide a specimen of breath and was arrested, and police noted a strong smell of intoxicating liquor.

Jim Osborne, defending, said Tuckey had a conversation with his boss over the phone and that was the reason he did not provide a sample.

He said his boss told him police had no reason to stop him and he did not need to comply with the police procedure, but he now understood he should have.

Mr Osborne said Tuckey had not even consumed alcohol and was now likely to lose his job.

Tuckey saw his case adjourned to June 30 for a pre-sentence report.

He was handed an interim driving disqualification.
