AN ISLE of Wight man who shot and injured a protected bird, which later had to be put down, has been sentenced.

Sunny Evelight, of Fleet Way, Shalfeet, appeared before Isle of Wight magistrates today (Friday). 

The 25-year-old admitted firing an air rifle beyond premises, in Shalfleet on June 30, and a further charge of injuring a non-schedule 1 wild bird, namely a black headed gull. 

Prosecutor, Liz Miller, told the court Evelight shot the gull with an air rifle while he was in his garden.

She said it was able to fly off, but landed in a neighbour's garden and was found by young children. One neighbour told police they heard the shots being fired and a bird shrieking.

Ms Miller said the gull suffered extensive damage to its wing and was later euthanised by a vet, who conceded nothing could be done to save it. 

Jim Osborne, defending, said Evelight had pleaded guilty and deeply regretted his actions, especially in light of hearing that children had tried to save the bird's life. 

Previously, the court heard that Evelight had mental health difficulties. 

A probation report was carried out, and magistrates followed the recommendations of the report.

Evelight was given an 18-month community order to include 20 rehabilitation days. 

He must pay £85 costs and a £114 surcharge.

The gun will be destroyed.
