Isle of Wight Magistrates gave the man the benefit of the doubt.
AN ISLE of Wight man accused of flouting the terms of a restraining order to stay away from a local woman, failed to attend a hearing before Island magistrates on Tuesday morning.
Andrew Smith, of Gobles Close, Ryde, was due to face a charge of breaching a restraining order. The breach was for offences of harassment in East Cowes and Ryde between January 12 and February 12.
Magistrates made him subject to a restraining order on September 20 last year.
The bench was told Mr Smith had just been in hospital so there was doubt as to whether he had received the summons in time and decided to give him the benefit of the doubt.
Magistrates bailed the 61-year-old to reappear at the Isle of Wight Magistrates' Court on March 29.
