A MAN who was stopped by police for his erratic driving ended up in court after he refused to do a drugs test.

Samuel Lewis Carvin, 33, of The Broadway, Totland, was stopped by police after he was spotted driving at speed onto Lushington Hill, Tim Cole, prosecuting, told Isle of Wight Magistrates' Court.

Police found two bags of cannabis under a car seat and Carvin was arrested.

At the station, he refused to give a sample of blood for analysis, Mr Cole said.

Carvin admitted a charge of failing to provide a specimen for analysis and possession of a class B drug.

For Carvin, Barry Arnett said his client had mild learning difficulties and did not provide a sample because he felt the police officer was being aggressive with him and he wanted to speak to a solicitor before he gave it, but was unable to do so.

Mr Arnett said the vehicle was new to Carvin and he was not used to driving it.

He said that Carvin used cannabis to help him sleep.

A probation officer told the court that at the time of the incident, Carvin said he had just got up from sleeping after a night shift and was adamant that he had not been under the influence of cannabis at the time and the drugs found in the car were only there because he picked up the wrong bag when he went out.

The probation officer said Carvin clashed with the police officer and sees himself as the victim in this case.

Carvin told probation that when the police officer said 'if you don't give a sample, you will be committing a further offence', he didn't understand, but the officer just repeated the line and it got him frustrated.

Magistrates sentenced Carvin to a 12 month community order with ten rehabilitation days, 120 hours of unpaid work and a 22 month driving ban.
