THE ISLE OF WIGHT COUNCIL
(VARIOUS STREETS, ISLE OF WIGHT) (SPEED LIMITS) ORDER NO 2 2021

Notice is hereby given that the Isle of Wight Council in exercise of their powers under section 82, 83, 84 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 and with all other enabling power and after consultation with The Chief Officer of Police in accordance with Part III of Schedule 9 to the Act has made an order, the effect of which will be:
1. To revoke the provisions of 'The Isle of Wight Council (Various Streets, Isle of Wight) (Speed Limits) Order No 1 2020.
2. To re-enact the provisions contained therein subject to the following amendments:
a. To revoke the 40mph speed restriction in the following lengths of road:
Ashey Road, between a point 217 metres south of its junction with Smallbrook Lane and a point 320 metres north of its junction with Smallbrook Lane. Carters Road, Ryde between its junction with Ashey Road and a point approximately 100 metres west thereof. Smallbrook Lane, Ryde between its junction with Ashey Road and a point 540 metres west of its junction with Great Preston Road.
b. To introduce a 30mph speed restriction in the following lengths of road:
Ashey Road between a point 217 metres south of its junction with Smallbrook Lane and a point 320 metres north of its junction with Smallbrook Lane. Carters Road, Ryde between its junction with Ashey Road and a point approximately 100 metres west thereof. Smallbrook Lane, Ryde between its junction with Ashey Road and a point 540 metres west of its junction with Great Preston Road.
3. No speed limit imposed by this order applies to vehicles falling within regulation 3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment) Regulations 2011 when used in accordance with regulation 3(5) of those regulations.
The restrictions are being proposed to facilitate the passage on the road or any other road of any class of traffic (including pedestrians); for avoiding danger to persons or other traffic using the road or any other road or for preventing the likelihood of any such danger arising; and for preserving or improving the amenities of the area through which the road runs. This Order will come into operation at 0001 hours on 4 February 2022.
Any person who desires to question the validity of any of the said orders on the grounds that it is not within the powers of Section 1 of the said Act, as amended, or on the grounds that any requirement of the Act or any instrument made under it has not been complied with in relation to this order may, within six weeks of the date hereof, apply to the High Court for the purpose.
